Information on Cancellation

Right of Cancellation

You have the right to cancel this agreement within 30 days without giving any reason.

The withdrawal period is 30 days from the date:

on which you or a third party designated by you (other than the carrier) took possession of the goods, provided that you ordered one or more items in a single order and these were delivered at the same time;

on which you or a third party designated by you (other than the carrier) took possession of the last goods, provided that you ordered multiple goods in a single order and these were delivered separately.

To exercise your right of withdrawal, you must inform us of your decision to withdraw from this agreement. This can be done via email: SUPPORT@elenaboutique.com.

You may use the attached standard withdrawal form, but this is not mandatory.

To meet the cancellation deadline, it is sufficient for you to send the notice of exercising your right of cancellation before the cancellation period expires.

Consequences of Cancellation

If you withdraw from this agreement, we will refund all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a delivery method other than the standard delivery we offer), immediately and no later than 30 days after receiving your notice of withdrawal.

For this refund, we will use the same payment method you used for the original transaction, unless otherwise expressly agreed. Under no circumstances will you be charged any fees as a result of this refund.

We may withhold the refund until we:

have received the returned goods, or
you have provided proof that you have returned the goods, whichever occurs first.

You must return or hand over the goods to us immediately and no later than 30 days from the date on which you informed us of the cancellation of the contract. The deadline is met if you return the goods before the 30-day period expires.

You are responsible for the direct costs of returning the goods.

You are only liable for any loss in value of the goods if such loss is due to handling of the goods beyond what is necessary to determine their nature, characteristics, and functioning.

Reasons for exclusion and lapse of the right of withdrawal

The right of withdrawal does not apply to contracts:

  • for the delivery of goods that are not prefabricated and are manufactured based on an individual choice or decision by the consumer;
  • for the delivery of goods that are liable to deteriorate rapidly or have a limited shelf life;
  • for the delivery of alcoholic beverages whose price was agreed upon at the time of the contract’s conclusion, but which cannot be delivered until at least 30 days after the contract’s conclusion, and whose value depends on market fluctuations;
  • for the delivery of newspapers, periodicals, or magazines, with the exception of subscriptions.

The right of withdrawal expires prematurely for contracts:

  • for the delivery of sealed goods that, for health or hygiene reasons, are not suitable for return if the seal has been broken after delivery;
  • for the delivery of goods that, after delivery, have become inseparably mixed with other goods due to their nature;
  • for the delivery of audio and video recordings as well as computer software in sealed packaging, if the seal has been broken after delivery.
